The new EB-5 draft memo "Guidance on the Job Creation Requirement and Sustainment of the Investment for EB-5 Adjudication of Form I-526 and Form I-829" recently released from USCIS is open to comments from August 10 to September 8, 2015. This policy memorandum provides guidance on EB-5 applications regarding job creation and the requirements to sustain the jobs during the conditional residence period.
